Privacy Notice

‍Please read this “Privacy Notice” carefully. Buildr LLC (hereinafter, “Buildr”, “we”, “our” or “us”) provides cloud-based construction software and related solutions, headquartered in California, United States.

Buildr values the protection of your privacy and maintaining your trust in our services. This Privacy Notice is intended to address the privacy regulations applicable to the activities and services we perform.

By using the Sites, Buildr Platform, or otherwise providing your Personal Data in connection with any other Services performed for or provided to you by Buildr, you acknowledge and agree that you have received and reviewed this Privacy Notice, and that your Personal Data will be handled as described in this Privacy Notice and subject to any applicable terms of use (each of the foregoing capitalized terms, as defined in the (Buildr’s Services and Scope of Privacy Notice section below). We may update this Privacy Notice as described in the Privacy Notice Changes section below.

Please be aware that data privacy laws can vary in the different jurisdictions where Buildr operates. In some jurisdictions other federal, state, and/or local laws (collectively “Local Laws”) may also apply, as further described in the Additional Data Subject Rights section below. If you’re a resident of California or Nevada, you should read the applicable sections below for specific rights applicable to residents of California and Nevada.

You may always contact us as described in the How to Contact Us section below if you have questions about this Privacy Notice, the processing of your Personal Data, or to exercise your rights as outlined below.

Buildr’s Services and Scope of Privacy Notice

Buildr’s Services

This Privacy Notice describes how Buildr processes and protects Personal Data collected for the following activities (“Services”):

  • visits to our websites such as: the Buildr website located at www.buildr.com, its subdomains, and any other Buildr websites that include an authorized link to this Privacy Notice appears ("Sites");
  • provision of our proprietary software-as-a-service construction platforms (“Buildr Platform”), mobile software applications (“Applications”), and other technologies that are licensed or made available by Buildr to its customers and their authorized users pursuant to the applicable Customer Agreement (as defined below).
  • engagement with The Slab, a Buildr newsletter;
  • communications such as phone calls, text messages, emails, communications through our support chatbot, faxes, or video calls;
  • registration and/or participation in our conferences and events (“Events”);
  • registration and/or participation in our online products including webinars, learning and training programs, and informative downloads;
  • participation in surveys or research initiatives;
  • visits to our branded social media pages (“Social Media”);
  • use of our products and services where we act as a controller of your Personal Data, including trial access to our Services and Buildr Platform (“Direct Sales”); and
  • any other websites, services, and/or applications provided by us that include a link and/or reference to this Privacy Notice, and any related services and/or new features or functionality provided by us through or in connection with any of the foregoing.

This Privacy Notice also explains our marketing practices generally. Please note, depending on how you interact or engage with us we may provide you with other privacy notices that include additional details about our information practices. For example, this Privacy Notice does not apply to job applicants and candidates who apply for employment with us, or to employees in the context of the employment relationship, which are subject to other notices.

Scope of Privacy Notice

This Privacy Notice applies to Personal Data that may be collected, received, and processed by us relating to:

  • “visitors” browsing or using our Websites or who interact with us through any pages or feeds of our accounts on any of our Social Media.
  • “customers” who have entered into Buildr’s master services agreement, terms of use, terms of service, or other agreement with Buildr for the use of the Buildr Platform and any other related Services (the “Customer Agreement”).
  • “authorized users” of our customers who are the employees, contractors, or personnel of the relevant customer, and any other individuals, group, or entities who are authorized by such customer to use the Buildr Platform.
  • all other users for whom Services are performed or provided by Buildr, whether registered or unregistered (such users, visitors, customers, and authorized users, referred to collectively as “users”).

Important Information Regarding Information Controlled by Our Customers

Our customers control the collection, use, and processing of Personal Data and other information that is submitted, uploaded, and/or otherwise provided in connection with their use of the Services, which may include Personal Data that relates to the applicable customer’s authorized users.

Except where there is a specific reference to an authorized user expressly stated herein, this Privacy Notice does not apply to the extent we process Personal Data of any authorized users on behalf of a customer; under such circumstances, we only process such Personal Data on behalf of and in accordance with the instructions from the applicable customer and the applicable data processing agreements, Customer Agreements, or other applicable agreements. Under relevant data protection laws, Buildr acts as the “data processor” or “service provider” on behalf of the applicable customer who is the “data controller” or “business”.

Our customers determine their own policies for handling Personal Data, and Buildr does not control our customers’ policies or the manner in which they handle Personal Data. The privacy practices of our customers may differ from those explained in this Privacy Notice.

If you are an authorized user, you are responsible for reviewing the policies, including any privacy policies, of the relevant customer.  If you have questions regarding how a customer processes your Personal Data or if you wish to exercise a data rights request as applicable under relevant data protection law, please contact the applicable customer.  Please note that if you submit any such request to us, we will forward it to the applicable customer.

What Is Personal Data

“Personal Data" means any data or information, in any form or medium, that on its own or when combined with other data could identify a particular individual, or any other data or information that constitutes personal data or personal information under applicable law. For example, it may include a person’s name, telephone number, email address, IP Address, or other unique identifiers. Personal Data does not include publicly available information, as defined by applicable law, de-identified information, or aggregated data.

What Personal Data We Collect

The Personal Data we collect in connection with the use of the Services depends on how and why you use the Services.  For example, the information that we may process about visitors is more limited than the information we may process if you are a customer.  Note that you may choose not to provide Personal Data directly to us or to not use the Services. However, some Personal Data is necessary so that we can provide you with the Services you have requested. Failure to provide this information may prevent us from providing you with access to the Services. The following describes the categories of Personal Data we may collect from you.

Categories of Personal Data:

  • Personal Identifiers: If you are a customer or authorized user, or if you submit or provide any information to us in connection with the Services, we may collect personal identifiers, such as name, alias, signature, postal address, phone numbers, unique personal identifier, online identifier, Internet Protocol (IP) address, email address.
  • Login Credentials: if you register for an account for the Services, we may collect account name/username, password, and/or other login credentials.
  • Customer Data: if you are a customer or an authorized user, we may collect information, data, and other content uploaded, submitted, or posted to the Buildr Platform or otherwise transmitted by or on behalf of a customer or any authorized user through the access and/or use of the Buildr Platform by or on behalf of customer and/or its authorized users.
  • Commercial information: if you are a customer or authorized user, we may collect commercial information such as records of personal property, products or services purchased, obtained, or considered; and other purchasing or consuming histories. We may also collect customer record information, such as billing or service address, insurance policy number, contracting contact information, and similar account details or any combination of the previously mentioned.
  • Financial Information: if you are a customer or authorized user, we may collect certain financial information, such as payment history, bank account information, bank statements, tax information, credit or debit card number, other financial information for purposes of contracting, insurance, financing applications, or payments.
  • Internet and Network Activity Data (“Usage Data”): for all users, we collect Usage Data, such as information required to provide access to Buildr’s systems and networks, including IP addresses, log files, and login information, the type of Web browser you use; device type; your operating system; your web request; your Internet Service Provider and cookies; referring/exit pages and URLs; payload errors, the pages you view and how you interact with links; the time and duration of your visits to the Sites or use of the Buildr Platform; and session replays collected using third party services that employ software code to record users’ interactions with the Services, such as users’ clicks, mouse movements, scrolls, and keystrokes/key touches during those sessions. Session replays help us diagnose usability problems and identify areas for improvement.
  • Approximate Location Data: for all users, we may collect approximate location data, such as region, country, state, postal code, or location information derived from your IP address and/or Event or visitor badging.
  • Audio, Visual, and Similar Information: if you are a customer or authorized user or if you participate in any of our Events, we may collect audiovisual or similar information, such as CCTV footage, photographs, and audio/video recordings (e.g., recorded meetings and webinars).
  • Professional Information: If you are a customer or authorized user, or if you submit or provide any information to us in connection with the Services, we may collect professional or employment-related information such as current and former employer(s) and position(s), office location, business contact information, professional memberships.
  • Inferences: for all users, we may collect inferences drawn from any of the information identified above, such as a summary of financial performance for financing and insurance as necessary as well as usage history of Buildr Sites and predictions about consumer preferences.

Where we Collect Personal Data

Most often, the Personal Data we collect about you is collected from you directly. In some cases, we may collect Personal Data automatically, such as Usage Data, when you engage with Sites, Services, networks, and technology resources. Buildr may also collect Personal Data through our service providers, as further described below.

Categories of Sources:

  • You: We may collect Personal Data directly from you when you engage with the Sites, set up accounts, sign up for or engage in any of our Services, register for Events, contact customer support via telephone, chatbot, or email, engage with Social Media, engage with our Services, conduct site visits, or otherwise contact us.
  • Buildr Customers: if you are an authorized user, we may collect Personal Data about you from our customers who you share your data with for purposes of providing the Services to the applicable customer pursuant to the Customer Agreement .
  • Service Providers or Other Third Parties: we may collect Personal Data about you from Service Providers (as defined below) who provide services on our behalf (as further described in the Who We Share Your Personal Data With section below), such as vendors that assist us with marketing efforts or that perform web hosting services, or from other third parties that provide data collection services.
  • Third Party Integrations:  If you use any products, services, software, applications, content, and/or features (including, without limitation, data products and services) that Buildr has integrated with, and/or has otherwise made accessible for use through, the Services (collectively, “Third Party Integrations”), we may receive information about you from the providers of such Third Party Integrations or through the integration related to your use thereof in connection with the Services.
  • Marketing and Advertising:  We may receive personal data about you from partners to supplement the information we collect and from partners with whom we work for measurement, analytics, and attribution.  We may also use certain third party analytics providers, advertising partners, and tools that may use cookies and similar technologies, including, for targeted advertising purposes as described in the Cookies and Other Tracking Technologies; Advertising section below.
  • Please Note - if you see our ads on any third party sites or platforms (including any social media platforms, you should always review the applicable privacy policies for any third party ad networks and/or sites before interacting or clicking on the advertisement to understand the data collection and privacy practices of such third party and how you can manage your preferences with respect to advertisements from the ad provider.
  • Publicly Available Sources: we may collect Personal Data about you from publicly available sources such as social media (e.g., LinkedIn), online business profiles, and/or webpages, which may include your name, or a publicly available business address, and related activity on such profiles, social media accounts, and/or webpages.
  • Social Media:  If you interact with us through any of our Social Media platforms, we may collect information such as your name, username, demographic information, contact information such as email address, location, interests, and publicly posted data such as your social media activity.
  • Automatically Collected Data: We automatically collect Usage Data regarding the actions you take on the Sites, Services, Direct Sales and the Buildr Platform from your browser, device, or network activity. This type of data helps us understand trends in our users’ needs so we can better consider new features or otherwise tailor the Sites and Buildr Platform.
  • Other Sources: We may receive information about you from other sources, including your company, third parties, Buildr customers or authorized users, referrals, or visitors. To the extent permitted by applicable law, we may combine this data with information we already have about you. If others give us your Personal Data, we will only use that Personal Data for the purpose of providing, supporting, and improving Buildr services and other purposes that are compatible with the specific reason for which it was provided to us (for example, as part of a referral or marketing campaign).

Aggregated or De-Identified Data

With the Personal Data (including, Usage Data) collected by us, we may aggregate or de-identify such data and information so that it can no longer be used to identify you.  We use this information to analyze the effectiveness of the Services, to improve and add features to the Services, to conduct research and for other similar purposes. In addition, from time to time, we may share or publish aggregated information like general user statistics with third parties.  We collect this information through the Services, through cookies, and through other means described in this Privacy Notice. We will maintain and use de-identified information in anonymous or de-identified form and we will not attempt to re-identify the information, unless required by law.

Who We Share Your Personal Data With

We take care to allow your Personal Data to be processed only by those who need access to perform their tasks and duties, to third parties or service providers that have a legitimate purpose for accessing it, and to those who you have provided consent to.

When we disclose Personal Data to our service providers and third parties, we generally enter into agreements with such parties that obligate them to process the Personal Data in accordance with applicable law, contract terms, and our specific instructions.

Recipients with Whom We Disclose Personal Data

  • Event sponsors: If you attend an Event or webinar organized by us, we may disclose your Personal Data with sponsors of the Event or webinar. If required by applicable law, you may consent to such sharing via the registration form or by allowing your attendee badge to be scanned at a sponsor booth. In these circumstances, your Personal Data will be subject to the sponsors’ privacy statements. If you do not wish for your Personal Data to be shared by Buildr, you may choose to not opt-in via event/webinar registration or elect to not have your badge scanned, or you can opt-out in accordance with Exercise Your Rights below.
  • Customers with whom you are affiliated: If you are granted access to our Services by a Buildr customer as an authorized user, we may disclose your Personal Data with the customer responsible for your access to our Services and otherwise in accordance with the customer’s instructions, including any applicable terms in the Customer Agreement. If you are an authorized user of a customer, please contact the relevant customer to learn more about how your information may be used, shared, and/or disclosed by us on their behalf.
  • Contest and promotion sponsors: With sponsors of contests or promotions for which you register in order to fulfill the contest or promotion.
  • Third party networks and websites: With third-party social media networks, advertising networks, and websites, so that Buildr can market and advertise on third party platforms and websites.
  • Service Providers: We may disclose your Personal Data with service providers that process Personal Data on behalf of Buildr to help us provide the Services (“Service Providers”). For example, we contract with Service Providers to provide certain services, such as hosting and maintenance, accounting, data analytics, and data storage and management. We only provide our Service Providers with the Personal Data necessary for them to perform these services on our behalf. Our Service Providers must generally agree to use reasonable security procedures and practices, appropriate to the nature of the information involved, to protect your Personal Data from unauthorized access, use, or disclosure. Service Providers are prohibited from using Personal Data other than as specified by Buildr. For a list of all Service Providers we use, please contact us via email at the email address provided in the How to Contact Us section below.
  • Employees and Contractors: We may make your Personal Data available to employees, contracted entities and individuals, and agents of Buildr and our affiliated and subsidiary entities (“Affiliates”) who are involved in providing or improving the Services that we offer to you. We obligate the employees, contractors, and agents of Buildr and our Affiliates to ensure the security and confidentiality of your Personal Data and to act on that Personal Data only in a manner consistent with this Privacy Notice.
  • Third Party Integrations: When you interact with and/or use Third Party Integrations, certain information may be exchanged between Buildr and the provider of the applicable Third Party Integration.
  • Note that the Third Party Integrations you choose to interact with and/or use, and their providers, are not our service providers. The applicable providers of Third Party Integrations may use personal information differently than we do and we do not control their use of your information.  Please review the privacy notices for the Third Party Integrations that you use in connection with the Services.
  • Regulatory and Government Entities: We may disclose your Personal Data with administrative, law enforcement, and regulatory agencies; tax authorities; corporate registries; and other public agencies or authorities. Buildr will cooperate with government and law enforcement officials and private parties to enforce and comply with the law. We may disclose Personal Data and any other content and information about you to government or law enforcement officials or private parties, if necessary, in order to respond to legal requests (including court orders and subpoenas), to protect the safety, property, or rights of Buildr or of any third party, to prevent or stop any illegal, unethical, or legally actionable activity, or to comply with the law. If you are an authorized user of a customer, please consult with the relevant customer to learn more about how they respond to requests for information pursuant to legal orders.
  • Professional Services: In certain instances, we may disclose your Personal Data with professional advisers acting as service providers, processors, or joint controllers - including lawyers, bankers, auditors, and insurers who provide consultancy, banking, legal, insurance and accounting services, and to the extent we are legally obliged to disclose or have a legitimate interest in disclosing your Personal Data.
  • Forums, Public Profiles, and Chat Rooms: Please be aware that whenever you disclose Personal Data on a publicly available page or any other public forum on the Sites or Buildr Platform, others may access that Personal Data. In addition, please remember that when you disclose Personal Data in any other communications with third parties, that information may be passed along or made public by others. This means that anyone with access to such Personal Data can potentially use it for any purpose, including sending unsolicited communications.
  • Business Transfers: We may also share data with third parties to whom we choose to sell, transfer, or merge parts of our business or our assets. Alternatively, we may seek to acquire other businesses or merge with them. If a change happens to our business, then the new owners may use your Personal Data in the same way as set out in this Privacy Notice.
  • With Your Consent: There may be situations where you are asked to consent to share Personal Data with third parties for additional reasons not included in this Privacy Notice.  In such event, we will only share such Personal Data if we have received your prior consent and only for the purposes listed in the request to share such information. Except where otherwise required by applicable law, your consent for the use and/or disclosure of your Personal Data in specific situations will continue in full force and effect until you revoke that consent, which you may do by contacting us at the email address provided in the How to Contact Us section below.  For the avoidance of doubt, the revocation of consent shall only apply to the use of the information after our receipt and processing of such request (which we shall process promptly and in accordance with applicable law), and not to any use or disclosure prior to such revocation in compliance with your consent.

How We Use Your Personal Data

We will normally collect Personal Data from you only where we have your consent to do so, where we need the Personal Data to perform a contract with you, or where the processing is in our legitimate interests and not overridden by your data protection interests or fundamental rights and freedoms. In some cases, we may also have a legal obligation to collect Personal Data from you or may otherwise need the Personal Data to protect your vital interests or those of another person.

Our purposes for collection include:

  • Auditing: Verifying data and auditing compliance with technical and organizational standards.
  • Security: Helping to ensure network, physical, and information security.
  • Improvements: Debugging and errors analysis, crash reporting, and analytics to improve existing intended functionality of Sites and Services.
  • Notifications and Communications: Providing non-personalized advertising and notifications and communications as part of interaction with Sites and Services, including the Buildr Platform, such as responses to queries and requests, to send emails and SMS text message communications according to your preferences, and updates regarding changes to policies related to the Services (including this Privacy Notice).
  • Provisioning the Services: Performing or providing the Services described above including maintaining or servicing accounts, profile management, providing customer service, processing or fulfilling orders and transactions, enabling access to Third Party Integrations, verifying information, processing payments, lien management, providing analytic services, providing storage, trial access, or providing functions.
  • Marketing and Engagement: Providing advertising and marketing services (including providing customized advertisements regarding our Services, where and as permitted under applicable law), event and newsletter subscription services, surveys, contests, other special offers, and customer reviews.
  • Internal Research and Development: Providing internal research for technological development and market analysis.
  • Prevent Fraud: Detecting, investigating, and preventing fraudulent transactions and other illegal activities.
  • Corporate Governance: Reporting and adherence to corporate governance requirements
  • Legal Compliance and Enforcing Legal Terms: Providing legal or regulatory compliance, including reporting possible criminal acts or threats to public security to a competent authority, reporting to data protection authority, or responding to an applicable court order, as well as enforcing our rights under our contracts and agreements.

We may also collect and use data for carrying out any other limited purpose described to you at the time the information was collected.

How We Use Usage Data

We may store Usage Data itself and such information may be included in databases owned and maintained by Buildr service providers or third-party advertising and analytics providers. We may use such information and pool it with other information, for example, to track the total number of visitors to our Sites or authorized users of the Buildr Platform, or each page of our Sites, etc. We use this information to help us understand how people use the Sites and Buildr Platform, support our advertising and marketing efforts, and to enhance our Services.

Our mobile application may collect certain additional information automatically, including the type of mobile device you use, your mobile device’s unique device ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browsers you use, available storage space, connection type (e.g., WiFi vs. cellular), and information about the way you use the application. We may also use GPS technology (or other similar technology) to determine your current location. If you do not want us to have your location information, you should turn off location services for the mobile application located in your account settings or in your mobile phone settings or within the mobile application.

We use mobile analytics software to allow us to better understand the functionality of our mobile software on your phone. This software may record information such as how often you use the application, the events that occur within the application, aggregated usage, performance data, and where the application was downloaded. We link certain information we store within the analytics software to authorized users for customer usage and metrics, and to aid in customer success.

Marketing Communications

If you have not otherwise opted out (or with your consent where required by applicable law), or if you have opted in to receive direct marketing communications from us, we may use your Personal Data to send you marketing information about the Buildr business, the Services, new product releases, new feature releases of the Services, and/or other products and services, that we think may interest you.  We carry out direct marketing by email, phone, SMS text messages, and physical mail.

If you no longer wish to receive marketing communications, you have the right at any time to opt out as further explained in the Your Rights section below.

Cookies and Other Tracking Technologies; Advertising

We or third parties authorized by us, including, third party advertising partners and networks, may utilize automated technologies deployed through our Services that are designed to collect certain Usage Data. Such technologies may include cookies and a range of technologies similar in function to the traditional cookies described above, such as pixel tags, also called web beacons or single-pixel tags/gifs, SDKs, local or web storage, and embedded scripts, as further described below.

Cookies and Web Beacons: We may use cookies (a small text file placed on your computer to identify your computer and browser) and web beacons (a file placed on a website that monitors usage) to improve the experience of the Sites and Buildr Platform, such as pre-populating your username for easier login, to allow user-specific messaging, or to permit user-specific advertising.

You can remove persistent cookies and change your privacy preferences by following directions provided in your Internet browser’s “help” directory. However, certain features of the Sites or Buildr Platform may not work if you delete or disable cookies. Some of our service providers may use their own cookies and web beacons in connection with the services they perform on our behalf, as further explained below.

We and our partners use similar technologies to analyze trends, administer the website, track users’ movements around the website, and to gather demographic information about our user base as a whole. Users can control the use of cookies at the individual browser level. You can find more information about cookies at: www.allaboutcookies.org.

App technologies. App technologies are technologies included in apps that are not browser-based like cookies. For example, our Applications may include Software Development Kits (SDKs), which are tools released by third parties that provide certain functionality. When you access our Applications, these technologies may permit us or a third party to collect information from your browser or device.

Third-party Targeted Advertising Technologies: Third parties, such as ad servers, ad networks, and data exchanges (“Advertisers”) may place or recognize a unique cookie on your computer or use other technologies such as web beacons so that they can tailor their advertisements to your apparent interests and deliver those advertisements to you while you are on our Sites. In addition, Advertisers use technologies (such as cookies, pixels, and web beacons) to collect information about your browsing behavior on our Sites which they may match with information they have previously collected. Our Privacy Notice does not cover any use of information that Advertisers may collect from you or that you choose to provide to them.

Session Replay Technologies:  We use session replay technology to help us understand how users interact with our website and improve their experience. This technology captures user interactions—such as clicks, scrolling, and typing behavior—so we can identify usability issues and optimize our content. Sensitive information is automatically masked, and we do not use session replay services to collect or store passwords, credit card numbers, or other sensitive data.

Social Media Widgets: Our website includes social media features, such as widgets, a “Share this” button or interactive mini-programs that run on our website. These features may collect your Internet Protocol address, which page you are visiting on our website, and may set a cookie to enable the feature to function properly. Social media features and widgets are either hosted by a third party or hosted directly on our website. Your interactions with these features are governed by the privacy statement of the company providing the features.

Your Choices

Where required by applicable law, we will obtain your consent prior to setting cookies or any session replay technologies (except for strictly necessary cookies). For more information on how you can manage your cookie preferences, please see the Your Rights section below.

Children's Privacy

We do not knowingly collect Personal Data from children under the age of 13. If we become aware that we have inadvertently received Personal Data from a child under the age of 13, we will delete such information from our records.

Sensitive Data

Buildr does not require you to provide any sensitive data about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, health and genetics, or biometric data to use the Services.

Security

Buildr implements appropriate physical, operational, and technical safeguards designed to help protect your Personal Data from accidental or unlawful destruction, loss, alteration, unauthorized disclosure, or access to the Personal Data we collect or use. We also contractually require that our Service Providers protect such information from accidental or unlawful destruction, loss, alteration, unauthorized disclosure or access.

Please be aware that despite our efforts, no data security measures can guarantee security. As a result, while we strive to protect Personal Data transmitted on or through the Sites, we cannot and do not guarantee the security of any information you transmit on or through the Sites. Device-users are responsible for the protection of personal devices and password credentials.

Data Retention

We will retain your information for as long as we have an ongoing business relationship with you or the business needs to do so (for example: to comply with applicable law, tax requirements, or enforce our agreements).

When we have no ongoing legitimate business need to process your Personal Data, we may either delete or de-identify it, or, if this is not possible (for example, because your Personal Data has been stored in backup archives), then we will securely store your Personal Data and isolate it from any further processing until deletion is possible. If we collect or use de-identified information, we will not attempt to re-identify it.

If you are an authorized user of a customer, contact the relevant customer regarding the customer’s data retention policies.

Third Parties/Links

If you download the Application, your app store (e.g., Apple App Store or Google Play) may collect certain information in connection with your use of the applications, including, without limitation, personal data, geolocational information, and other usage-based data. We have no control over the collection of such information by a third-party app store, and any such collection or use will be subject to that third party’s applicable privacy policies

In addition, our Sites and Buildr Platform may contain links or integrate with other websites and online services or allow others to send you such links. Buildr is not responsible or liable for any damage or loss related to your use of any third-party website or online service. You should always read the terms and conditions and Privacy Notice of a third-party website or online service before using it, whether directly or in connection with your use of the Sites or the Buildr Platform.

Third Party Social Media Plug-Ins

On or through the Services we may provide third-party “share” buttons which enable you to share certain content via social media sites (e.g., Facebook, Twitter, Instagram, YouTube, and LinkedIn). These “share” buttons may function as web beacons when you interact with the button. Please note that when you “share” using the buttons, you may send to the third party provider of the “share” button the information that you are viewing. If you are not logged into your account with the third party provider, then the third party may not know your identity. If you are logged in to your account with the third party, then the third party may be able to link information or actions about your interactions with the Services to your account with the applicable third party provider. Please refer to each third party’s privacy policies to learn more about its data practices.

Your Rights

You may opt not to disclose Personal Data to us, but keep in mind some Personal Data may be needed to register with us or to use some of our features. If we have collected and processed your Personal Data with your consent, you can withdraw your consent at any time. Withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect the processing of your Personal Data conducted in reliance on lawful processing grounds other than consent.

Please note that we may still use any aggregated and de-identified Personal Data that does not identify any individual and we may also retain and use your Personal Data As necessary to comply with our legal obligations, resolve disputes, or enforce our agreements.

You have several rights with respect to your Personal Data, as further described in this section.

How to Update and Access Your Personal Data

It is important that the Personal Data contained in our records is both accurate and current. We offer various self-help functions within our Site, tools, and Services that will allow you to update your Personal Data in our records. If we have Personal Data that you cannot access via these self-service systems, then you may make a request through the Security Team by email at security@buildr.com.

Marketing Communications

You can opt out of receiving marketing and non-transactional communications sent from us by e-mail at any time by using the unsubscribe link in the email communications we send. To stop receiving SMS marketing communications from us, you can opt out at any time by responding with the opt-out notice indicated in the SMS communication. You may also turn off push notifications from the Application on your device. To opt out of any other forms of marketing (such as postal marketing or telemarketing), please contact us using the contact details provided in the How to Contact Us section below.

We will use commercially reasonable efforts to process such requests in a timely manner.  Note that you cannot opt out of receiving transactional e-mails or communications related to the Services (e.g., requests for support), which, for clarification, are not marketing communications.

Cookies, Analytics, & Targeted Advertising

You can learn how to manage cookies and opt-out of cookies being placed on your device by visiting http://www.allaboutcookies.org/manage-cookies/index.html.

  • Browser Settings:  You may alter the Cookie settings in your browser settings at any time. Some browser providers offer comprehensive help relating to cookie management in their products. You may elect to accept all or only certain cookies. If you disable cookies in your browser settings, however, you may find that certain portions or functionality of the Services will not work.
  • Do Not Track Preferences:  You may turn on the Do Not Track (“DNT”) setting in your browser, which will enable your browser to send a special signal to websites, analytics companies, plug in providers, and other web services you encounter while browsing to stop tracking your activity. To turn on your DNT signal, please visit  https://allaboutdnt.com/#adjust-settings.
  • There is no consensus among industry participants as to what “Do Not Track” means in this context.  Like many websites and online services, Rocket File does not currently alter our practices when we receive a DNT signal or other similar transmissions that indicate a request to disable online tracking of users who use our Services, except as specifically required by law.  For information about “Do Not Track” please visit All About DNT.
  • Web Beacons and Pixels:  You may avoid web beacons and pixels by disabling the functionality that allows remote images to load in your email account and refraining from clicking on any links in email messages.
  • Google Analytics Opt-Out:   You can download the Google Analytics opt-out browser add-on at: https://tools.google.com/dlpage/gaoptout/
  • Advertiser Specific Opt-Outs - Targeting/Advertising Cookies:
    • DAA: You may use the Digital Advertising Alliance (“DAA”) consumer choice tools to apply opt-outs to interest-based advertising and other applicable uses of web-viewing data by DAA participating companies by visiting http://optout.aboutads.info/?c=2&lang=EN#completed.
    • NAI: You may also manage opt-outs through the Network Advertising Initiative (“NAI”) opt-out tool at http://optout.networkadvertising.org/?c=1

Additional Data Subject Rights

The notices and choices described above apply to all users, and users can access, delete, or take other actions with respect to their accounts and personal information (as applicable). In addition, to the extent Buildr is subject to relevant Local Laws, residents of certain jurisdictions may have additional rights regarding your Personal Data depending on where you reside. Below is an explanation of some of the additional privacy rights that may be available to you. Please note, these rights do not conflict with any rights you may have under the applicable Local Law. Buildr will not discriminate against you for exercising any of your privacy rights.

Subject to conditions set forth in applicable data protection legislation, you may have the following rights:

Right to Know/Be Informed: You have the right to know and understand what Personal data we collect and how we process it.

Right to Access: You have the right to request access to any Personal Data concerning you, subject to limited exceptions that may be prescribed by applicable law.

Right to Correct (Rectification): Buildr aims to ensure that all of your Personal Data is correct. You are entitled to have any inadequate, incomplete or incorrect Personal Data corrected (that is, rectified).

Right to Withdraw Consent: In the event your Personal Data is processed on the basis of your consent, you have the right to withdraw consent at any time, without affecting the lawfulness of processing based on consent before its withdrawal.

Right to Data Portability: Where we rely upon your consent as the legal basis for processing, or the fact that the processing is necessary to perform a contract to which you are party or to take steps at your request prior to entering a contract, and the Personal Data is processed by automated means, you have the right to receive all such Personal Data which you have provided to us in a structured, commonly used and machine-readable format, and also to require us to transmit it to another controller where this is technically feasible.

Right to Erasure: You are entitled to have your Personal Data erased under specific circumstances, such as where you have withdrawn your consent, where you object to processing based on legitimate interests and we have no overriding legitimate grounds or where Personal Data is unlawfully processed.

Right to Restriction of Processing (Limit Use and Disclosure): You have the right to restrict our processing of your Personal Data under the below circumstances. Where your Personal Data is subject to restriction, we will only process it with your consent or for the establishment, exercise or defense of legal claims.

  • you contest the accuracy of the Personal Data, until we have taken sufficient steps to correct or verify its accuracy;
  • where the processing is unlawful but you do not want us to erase the Personal Data;
  • where we no longer need your Personal Data for the purposes of the processing, but you require such Personal Data for the establishment, exercise or defense of legal claims;
  • or where you have objected to processing justified on legitimate interest grounds (see below), pending verification as to whether we have compelling legitimate grounds to continue processing.

Right to object to processing justified on legitimate interest grounds: Where we are relying upon legitimate interest to process Personal Data, you may have the right to object to that processing based on grounds related to your particular situation. If you object, we must stop that processing unless we can demonstrate compelling legitimate grounds for the processing that override your interests, rights and freedoms, or we need to process thePersonal Data for the establishment, exercise or defense of legal claims. Where we rely upon legitimate interest as a basis for processing, we believe that we can demonstrate such compelling legitimate grounds, but we will consider each case on an individual basis.

Right to lodge a complaint: You may lodge a complaint with the supervisory authority of your habitual residence, place of work or place of alleged infringement.

Exercise your Rights

To ask any questions regarding the processing of your Personal Data, please contact the Security Team by email at security@buildr.com.

Only you or someone legally authorized to act on your behalf may make a verifiable consumer request related to your Personal Data. You may also make a verifiable request on behalf of your minor child. You may designate someone as an authorized agent to submit requests and act on your behalf. We will respond to all requests in accordance with applicable laws. We may ask you for information to verify your identity and evaluate your privacy rights request.

Your Rights Where You Have Been Granted Access to the Buildr Platform by a Customer

As described above, we may also process Personal Data submitted by or for a customer. To this end, unless stated otherwise in this Privacy Notice or in a separate disclosure, we process such Personal Data as a processor/service provider on behalf of our customers. If your data has been submitted to us in our role as a processor/service provider and you wish to exercise any rights you may have under applicable data protection laws, please directly inquire with the customer that granted you access to the Buildr Platform. Because we may only access a customer’s data upon their instructions, if you wish to make your request directly to us, please provide us with the name of the Buildr customer(s) and project name(s) relevant to your request. We will refer your request to that customer and will support them as needed in responding to your request.

Privacy Notice Changes

This Privacy Notice is reviewed and updated periodically to ensure it accurately describes our practices and procedures. We may also make updates or changes to this Privacy Notice because of changes in applicable laws or regulations. Except for any material changes described below, any changes made to this Privacy Notice are effective as of the “Last Updated'' reference above. If necessary, we may take additional measures to inform you of changes, such as by posting a prominent notice on our Site.

If we make any material changes to this Privacy Notice, we will provide you with reasonable notice prior to such change taking effect by sending a notification to the email address we have on file for you, and may also post a prominent notice of any such changes on our Sites. Material changes to this Privacy Notice will become effective on the date set forth in the notice. It is your responsibility to regularly visit and review this Privacy Notice.

Notice to California Residents - Shine the Light Disclosure

California residents who have provided us with Personal Data have the right (under California Civil Code§ 1798.83) to request and obtain from us, once each year, the details of any Personal Data we shared with a third party for that third party’s direct marketing purposes during the prior calendar year. The details would include the categories of Personal Data and the names and addresses of the third party with which it was shared.

Buildr does not currently share Personal Data of California residents with any third party for that third party’s direct marketing purposes.

To request information about this sharing, you may submit a request to the email address provided in the How to Contact Us Section below, with “Your California Privacy Rights” in the subject line, along with your first and last name, Account email address and/or login ID (if applicable), and complete mailing address (including street address, city, state, and zip code).

Notice to Nevada Residents

Under Nevada law, Nevada “consumers” (individuals who are seeking or acquiring goods/services for personal, family, or household purposes) may opt out of the sale of covered personal information.

Buildr does not currently sell covered information of Nevada consumers as defined under applicable Nevada law.

You may submit an opt-out request by sending your request to the email address provided in the How to Contact Us Section below, along with your full name, complete mailing address (including street address, city, state, and zip code), email address (so that we can contact you, if needed, in connection with the request) and confirmation that you are a Nevada resident.

International Transfers

The Personal Data that we collect or receive may be transferred to and processed in countries located outside of your country of residence to the countries where we or our third-party service providers process such information. The data protection laws of the countries where Personal Data is processed may not be as comprehensive as or equivalent to those in your country of residence.

We rely on legally-provided mechanisms to transfer Personal Data across borders where and as required under applicable law.
